Terms and Conditions for Zegicon

1. Introduction & Acceptance of Terms
Welcome to Zegicon(“we,” “us,” “our,” or “Zegicon”). We provide a mobile and web-based platform (the “Platform”) that connects users seeking to rent or buy properties (“Users”) with licensed real estate agents, property managers, and developers (“Agents”).
By downloading, accessing, or using the Proptlink Platform, you agree to be bound by these Terms and Conditions (“Terms”) and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Platform. We reserve the right to modify these Terms at any time.
2. Definitions
Platform: The Proptlink mobile application and website, including all its features and services.
User: An individual who uses the Platform to search for properties to rent or buy.
Agent: An individual or entity (real estate agent, agency, or property developer) who lists properties on the Platform.
Content: Any information, text, graphics, photos, or other materials uploaded, downloaded, or appearing on the Platform.
Listing: A property advertisement posted by an Agent on the Platform.
3. The Proptlink Service
Proptlink is a technology platform that acts as a neutral venue. We are not a real estate brokerage, agent, or insurer.
We do not own, sell, rent, or manage any of the properties listed on our Platform.
We are not a party to any agreement entered into between Users and Agents.
We have no control over the conduct of Users or Agents and disclaim all liability in this regard to the maximum extent permitted by law.
We do not verify the accuracy, legality, or authenticity of any Listing or the professional qualifications of any Agent beyond a basic verification process. Users are responsible for conducting their own due diligence.
4. Account Registration
Users: To access certain features, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process.
Agents: To list properties, you must create an Agent account. You represent and warrant that you are a licensed and legally authorized real estate professional in your jurisdiction and that you have the legal right to market the properties you list.
You are responsible for safeguarding your password and for all activities that occur under your account.
5. Obligations and Conduct
All Parties (Users and Agents) Agree Not To:
Violate any applicable laws or regulations of the Federal Republic of Nigeria.
Post false, misleading, fraudulent, or deceptive information.
Infringe upon any third-party’s rights, including intellectual property and privacy rights.
Use the Platform to distribute spam or unsolicited commercial messages.
Scrape, crawl, or otherwise collect data from the Platform without our express written consent.
Circumvent any security measures we have in place.
Agent-Specific Obligations:
Ensure all property Listings are accurate, up-to-date, and not misleading.
Promptly remove Listings for properties that are no longer available.
Respond to User inquiries in a professional and timely manner.
6. Content and Intellectual Property
Proptlink’s IP: We own the Platform, including our logo, brand name, code, and design. You may not copy, modify, or distribute it without our permission.
Agent’s Content: By creating a Listing, you grant Zegicon a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, display, and distribute your Content (including photos and descriptions) in connection with operating and promoting the Platform. You warrant that you have the necessary rights to grant us this license.
7. Fees and Payments
Proptlink reserves the right to introduce fees for certain services, such as premium listings for Agents or other features. Any applicable fees will be clearly communicated to you before you incur them.
8. Disclaimers
THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. PROPTLINK DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE.
ProptKeyLink MAKES NO WARRANTY REGARDING THE QUALITY, ACCURACY, LEGALITY, OR SUITABILITY OF ANY LISTINGS, AGENTS, OR PROPERTIES. YOU ARE SOLELY RESPONSIBLE FOR ALL OF YOUR COMMUNICATIONS AND INTERACTIONS WITH OTHER USERS OR AGENTS ON THE PLATFORM.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, PROPTLINK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE PLATFORM; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE PLATFORM, INCLUDING ANY AGENT; OR (C) ANY TRANSACTION OR AGREEMENT INITIATED THROUGH THE PLATFORM.
10. Indemnification
You agree to release, defend, indemnify, and hold Proptlink and its affiliates harmless from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Platform or your violation of these Terms.
11. Termination
We may, in our discretion and without liability to you, with or without cause, with or without prior notice and at any time, decide to limit, suspend, deactivate, or cancel your account.
12. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria. Any dispute arising from these Terms or your use of the Platform shall be resolved in the competent courts of Rivers State, Nigeria.
